Terms & Conditions
1. Definitions
1.1 “Application” means an application for enrolment of an Applicant in a course provided by the College.
1.2 “Applicant” means the person in respect of whom an Application has been made.
1.3 “College” means Dance College Limited, 17 Gresse Street, London, W1T 1QL (company number: 09881964).
1.4 “Contract” means the Application and these Terms and Conditions.
1.5 “Course” means a course at the College in respect of which an Application has been made by or on behalf of an Applicant.
1.6 “Course Fees” means the fees payable in respect of a Course as set out in these Terms and Conditions.
1.7 “Terms and Conditions” means these terms and conditions.
1.8 “Website” means the website of the College.
2. Applications
2.1 These Terms and Conditions apply to the enrolment of the Applicant in the Course and provision of such Course by the College.
2.2 The College and the Applicant are bound by the Contract (including these Terms and Conditions) upon acceptance by the College of the Application made by or on behalf of the Applicant.
2.3 The Contract forms the entire agreement between the College and the Applicant with respect to the Course, and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between the College and Applicant, whether written or oral, relating to its subject matter.
2.4 The Contract shall remain in effect until either the completion of the Course or the cancellation of the Course in accordance with these Terms and Conditions.
2.5 The College may, in its sole discretion, accept or reject an Application and notify the Applicant in writing (including via email) accordingly.
2.6 The payment of any sum intended to be in respect of Course Fees by or on behalf of the Applicant does not oblige the College to accept an Application.
3. Payment Terms
3.1 Upon acceptance by the College of the Application made by or behalf of the Applicant, the Applicant is liable to the College for the Course Fees.
3.2 The College accepts payment of the Course Fees via the following means:
3.2.1 By direct debit to its account, the details of which are as follows: Name: Dance College Limited Bank: National Westminster Bank PLC Sort code: 56-00-27 Account Number: 26698218
3.2.2 By Worldpay, Visa Debit, MasterCard Credit, MasterCard Debit, Visa Electron, Maestro or JCB.
3.3 The College accepts payment of the Course Fees in pounds sterling.
3.4 Any currency conversion costs or other charges incurred in connection with the payment of Course Fees are to be paid in addition to the Course Fees. No deduction from the Course Fees for such costs or charges may be made.
3.5 The Course Fees and the payment options for those Course Fees shall be set out in writing by the College prior to the acceptance of any Application.
4. Provision of Courses
4.1 The Applicant will be solely responsible for determining whether the Course is sufficient and suitable for the needs of the Applicant. The College does not provide any guarantee in respect of the standard of an Applicant’s abilities on completion of the Course.
4.2 The Applicant will provide the College with all information reasonably requested by the College in relation to the Course.
4.3 Unless otherwise indicated in writing, Course Fees do not include travel, accommodation, subsistence, insurance or other costs that might arise prior to or during the Course.
4.4 Term dates for the Courses shall be specified in writing by the College and may be subject to variation by the College.
4.5 The Applicant agrees to comply with all applicable policies, procedures and regulations of the College.
4.6 The College reserves the right to remove an Applicant from any Course and/or exclude an Applicant from College premises with immediate effect if the Applicant’s behaviour is considered unacceptable.
4.7 The College reserves the right to remove an Applicant from any Course with immediate effect if the Applicant has not paid the Course Fees as required.
4.8 The Applicant warrants that they have all necessary visas, permissions and consents required for their stay in the United Kingdom and their attendance of the Course.
5. Cancellation and Amendment of Courses by the College
5.1 Courses have minimum required attendance levels and the College reserves the right to cancel or postpone the Course if the minimum required number of Applicants has not been accepted for the Course.
5.2 The College also reserves the right to cancel or postpone the Course if key personnel or key facilities are unavailable for the provision of the Course.
5.3 The College also reserves the right to:
5.3.1 change or amend the Course structure or content;
5.3.2 change or amend the individuals responsible for organising or delivering the Course; and
5.3.3 change the Course venue, time(s) and/or date(s).
5.4 The College will endeavour to inform Applicants about cancellations, postponements, and amendments to the Course with as much notice as reasonably practicable.
5.5 If the College cancels the Course, then the Course Fees or Discounted Course Fees as paid shall be refunded.
6. Cancellation of Enrolment in Courses by the Applicant
6.1 The Applicant may cancel their enrolment in a Course by providing notice in writing to the College within 7 days following the making of this Contract, following which period the Applicant must pay any reasonable losses and costs the College suffers because of that cancellation.
6.2 If the Applicant fails to attend the Course, no refund of Course Fees will be provided.
6.3 Applicants are responsible for complying with all United Kingdom entry and visa requirements and for obtaining the necessary consents to enable their participation in the Course. The rejection of a visa or other entry application by the British authorities does not affect the terms set out in these Terms and Conditions and the Applicant will remain liable for the Course Fees.
7. Limitation of Liability
7.1 Subject to clause
7.1.1 any indirect losses or damages, or to any loss of profits, loss of contracts or opportunity, whether direct or indirect, even if the College had been advised of the possibility of those losses or if they were within the College’s contemplation; or
7.1.2 any costs or expenses incurred by any person or organisation in connection with travel, accommodation, reservations or other arrangements.
7.2 In any event, subject to clause 7.3, the liability of the College to the Applicant with respect to provision of the Course, the cancellation, postponement, or amendment of the Course, any negligence, any breach of the Contract, or arising in any other way out of the subject matter of these Terms and Conditions is limited to the amount of Course Fees received from or on behalf of the Applicant in respect of the Course.
7.3 Nothing in the Contract will operate to limit to exclude the liability of the College for death or personal injury arising from the College’s negligence, fraud or any other liability that, by law, cannot be limited or excluded.
7.4 Views expressed by members of staff are their own. The College does not accept any liability for advice given or views expressed by members of staff or in any notes or documentation provided to Applicants.
7.5 Unless otherwise indicated, all courses are taught in English. The College does not accept any liability for any losses, costs or expenses incurred by or on behalf of the Applicant in connection with the Applicant’s lack of English language knowledge.
7.6 The College accepts no liability for loss or damage to the Applicant’s property and shall not provide any insurance cover whatsoever to the Applicant.
7.7 The warranties and undertakings given by the College in these Terms and Conditions are, to the extent permitted by law, given in lieu of all implied conditions, warranties, representations or other terms, including any relating to satisfactory quality, fitness for a particular or any purpose, or the ability to achieve any particular result.
8. General
8.1 The College will not be liable for any failure or delay in the performance, in whole or part, of any of its obligations in connection with the provision of the Course arising from or attributable to acts, circumstances, events, omissions or accidents beyond its reasonable control, including (without limitation):
8.1.1 acts of God, flood, drought, earthquake or other natural disaster;
8.1.2 epidemic or pandemic;
8.1.3 terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations;
8.1.4 nuclear, chemical or biological contamination;
8.1.5 any law or any action taken by a government or public authority;
8.1.6 collapse of buildings, fire, explosion or accident;
8.1.7 any labour or trade dispute, strikes, industrial action or lockouts;
8.1.8 non-performance by suppliers or subcontractors; and
8.1.9 interruption or failure of utility service.
8.2 These Terms and Conditions will be governed by and construed in accordance with English law. The English courts will have exclusive jurisdiction to deal with any dispute that has arisen or may arise out of or in connection with these Terms and Conditions.
8.3 The Contract is between the Applicant and the College. No other person shall have any rights to enforce any of its terms.
8.4 Each of the clauses in these Terms and Conditions operates separately. If any court or relevant authority decides that any of those clauses are unlawful, the remaining clauses shall remain in full force and effect.
8.5 All photographs and video footage created and/or recorded by the College during the Course remains the property of the College.
8.6 The Applicant and the College each agrees that they shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these Terms and Conditions.
8.7 If the Applicant wishes to contact the College in writing, or if any clause in these Terms and Conditions requires the Applicant to give notice in writing to the College, this can be done by email or by personal delivery or prepaid post to the College at 17 Gresse Street, London, W1T 1QL.
8.8 The College reserves the right to vary these Terms and Conditions in light of any changes in relevant laws and regulatory requirements.
